1. Who we are & acceptance
Kwiker is operated by DashDotSystems SH.P.K., a limited liability company registered in the Republic of Kosovo (unique identification number 812460880), Ramë Bugujevci 5, Fushë Kosovë, Kosovo. Kwiker is its brand. (“Kwiker”, “we”, “us”).
These Terms & Conditions (“Terms”) are a binding agreement between you and us. By creating an account you accept these Terms and acknowledge our Privacy Policy and Community Guidelines, which form part of these Terms. If you do not accept them, do not use Kwiker.
These Terms cover carpooling in the Kwiker app and on kwiker.app. Kwiker is testing other services, such as a taxi service, with a limited group of testers. Those services are not covered by these Terms and will have their own terms before they open to the public.
2. Definitions
- Platform — the Kwiker mobile app and the kwiker.app website.
- Driver — a verified user who publishes a route and offers empty seats in their own vehicle.
- Passenger — a user who requests and takes a seat on a published trip.
- Trip — a journey published by a driver on the platform.
- Contribution — the cash amount a passenger pays a driver toward the cost of the trip.
- Companion — a person without a Kwiker account for whom a passenger books a seat.
- User content — anything you upload or write on the platform: photos, trip details, messages, ratings and reports.
3. Kwiker's role — an intermediary, not a carrier
This section is important. Kwiker is a technology platform that connects drivers and passengers travelling the same way. Kwiker is not a taxi company, not a transport operator, not a carrier, and does not provide transport services.
Kwiker does not drive, employ, instruct or supervise drivers. Drivers are independent individuals driving their own vehicles on journeys they planned themselves. The ride arrangement is made between the passenger and the driver; Kwiker is not a party to it.
Kwiker does not check anyone's vehicle, driving licence, insurance, health or driving. The only check we carry out is identity verification of drivers (§7).
Kwiker works on a cost-sharing model: the contribution helps the driver cover the cost of the journey (such as fuel and wear), not make a profit. Contributions must stay within the cost-sharing limit shown in the app.
4. Who is responsible for the trip
The driver alone is responsible for the vehicle, its roadworthiness and registration, their driving licence, insurance, the way they drive, compliance with the law, and the safety of the journey.
The passenger is responsible for their own conduct, their own belongings, and the companions they bring.
Each user decides for themselves whether to travel with someone. Before you get into a car, or pick someone up, use your own judgement: check the name and photo, and do not set off if something does not feel right.
5. Eligibility & age
- You must be at least 16 years old to use Kwiker as a passenger. If you are under 18, you must have the permission of a parent or legal guardian.
- You must be at least 18 years old and hold a valid driving licence to offer rides as a driver.
- By accepting these Terms you confirm that you meet these requirements. We do not verify passengers' age; a driver's identity document is checked during verification (§7).
- You may not use Kwiker if we have previously removed you from the platform (§20).
6. Your account
You sign in with an email address and password, or with Google or Apple. You must provide accurate information, keep it up to date, and keep your password safe. One person, one account. You are responsible for activity under your account.
We do not verify phone numbers. Do not give someone else's number.
Impersonating another person, creating an account on someone else's behalf, or using a false identity is a serious breach and will result in removal.
7. Driver verification
Before offering rides, a driver must complete identity verification through our partner Didit: a scan of an official identity document and a face check (see Privacy §4). Passengers are not required to verify.
Verification is not a guarantee. It only confirms that the document is genuine and belongs to the person. It does not certify driving ability, a driving licence, the vehicle's condition, insurance, criminal record or conduct. We may refuse, re-run or revoke verification at any time.
8. Driver obligations
As a driver, you confirm and agree that you:
- hold a valid driving licence and are legally permitted to drive in each country on the route;
- own, or are lawfully entitled to use, the vehicle, and it is registered, roadworthy and compliant with the law;
- hold valid motor insurance covering the vehicle and its occupants for the journey — including carrying passengers under a cost-sharing arrangement. It is your responsibility to confirm this with your insurer;
- publish only journeys you genuinely intend to make, with an honest route, time and seat count;
- set a contribution that is a genuine share of costs and does not seek profit;
- never drive under the influence of alcohol, drugs, or medication that impairs driving;
- comply with all applicable traffic, transport, tax and border rules;
- do not operate a commercial transport or taxi service through the platform.
9. Passenger obligations
As a passenger, you agree to:
- arrive on time at the agreed pickup point, and tell the driver promptly if your plans change;
- pay the driver the agreed contribution in cash, for every seat you booked;
- behave respectfully toward the driver and other passengers, and wear a seatbelt;
- never carry an illegal, dangerous or prohibited item, and never ask a driver to break the law;
- respect the driver's vehicle and stated preferences (for example, luggage limits);
- look after your belongings — Kwiker does not keep or return lost items.
10. Booking & cash payment
A passenger requests a seat; the driver accepts or declines. A booking exists only once the driver has accepted the request.
The contribution is set by the driver and is paid in cash, directly to the driver, in the currency shown in the app (euro or lek). Kwiker processes no payments, takes no commission, holds no money, issues no receipts and is not a payment service.
Neither party may demand more than the agreed amount. Any dispute over payment is between the passenger and the driver. We may take it into account for moderation, but we are not a party to it and cannot refund or recover money.
11. Same-gender matching
Kwiker matches riders with drivers of the same gender. This is not a preference or a filter you can switch off: when you are signed in, you are only shown trips whose driver has the same gender as your account, and your own trips are only shown to people of that gender.
Signed-out visitors are shown all open routes, because we do not know their gender.
12. Companions
You can book seats for people travelling with you who do not have a Kwiker account. You are responsible for them: for their conduct during the trip, for the contribution for their seats, and for the accuracy of what you tell us about them.
Because riders and drivers are matched by gender (§11), you must tell us each companion's gender when you book. That is the only thing we ask about them, and the only thing we keep — see the Privacy Policy.
If you bring anyone of a different gender to the driver, we tell the driver before they accept, and we tell the people already on that trip.
You cannot cancel one companion's seat on its own — cancelling your booking cancels the whole group.
13. Cancellations & no-shows
Plans change. Both parties should cancel as early as possible, so the seat can be offered again or the passenger can find another ride.
- A passenger may cancel a request or a seat in the app at any time before the trip starts. Kwiker charges nothing.
- A driver may cancel a trip but must give a reason. Passengers with a seat, and those still waiting for an answer, are told, with that reason.
- When starting the trip, the driver can mark passengers who did not turn up as no-shows; they are removed from the trip.
- A trip that is never started is cancelled automatically 3 hours after its departure time.
- If a driver materially changes a trip after accepting you (for example, the time or the contribution), you may cancel without any consequence.
- Kwiker pays no compensation for cancellations, delays or no-shows. Repeated late cancellations or no-shows may lead to suspension (§20).
14. Ratings & reviews
After a completed trip, both parties may rate each other with a score, tags and a comment. Ratings are visible to other users. They must be honest, based on a real trip, and free of insult, discrimination, or personal data about others.
We may remove a rating that breaches these Terms or the Community Guidelines. When you delete your account, ratings you left for others remain without your name; ratings others left for you are deleted.
15. Messages
The in-app chat is for coordinating a trip. You can send text, photos, voice messages and locations. Do not send identity documents, bank details or unlawful content.
Deleting a conversation removes it from your own list only; it does not delete the messages and does not remove the conversation for the other person. Nothing in these Terms promises that a message will be delivered or read (see §17). We do not read your messages; see the Privacy Policy.
16. Prohibited conduct
You must not:
- harass, threaten, discriminate against, or endanger anyone;
- use Kwiker for any unlawful purpose, including smuggling or trafficking of any kind;
- post false trips, write fake reviews, or manipulate ratings;
- knowingly file false reports;
- scrape, reverse-engineer, overload, or interfere with the platform or its security;
- collect or misuse other users' personal data, or contact them for purposes unrelated to the trip;
- run a commercial transport, delivery or taxi operation through the platform;
- evade a suspension by creating a new account.
17. Blocking & reporting
You may block, and you may report, any other user. Blocking works both ways: once you block someone, neither of you will see the other's trips, be able to message the other, or be able to request or offer a seat to the other. We do not tell the person that you have blocked them. You can unblock at any time from Profile → Safety.
Blocking has limits you should know before you rely on it:
- if either of you has already been accepted onto a trip that has not finished, that booking stands and the conversation stays open until the trip ends — we will not strand a passenger, or cut a passenger off from their driver;
- it does not hide the other person's name, photo or rating, which every user can see;
- it does not remove ratings either of you has already left.
Messages sent to you by a person you have blocked are stored but never shown to you. Blocking may also create a report for our team — when you ask for one, and always when the block affects an accepted booking.
Our team reviews reports and prioritises those about physical safety, but we do not promise a specific response time. We may not be able to tell you what we decided about another person's account, because that is their personal data.
18. Safety features & their limits
Kwiker provides safety tools: identity verification of drivers, an SOS button, live trip sharing, emergency contacts, ratings, blocking and reporting.
These tools assist you; they do not guarantee your safety, and Kwiker is not an emergency service. The SOS button opens a call to the public emergency number (112 in Kosovo and Albania). During a trip in progress it also alerts your emergency contacts who use Kwiker, and prepares a live-location link that you send to anyone else yourself. It does not alert Kwiker staff. We do not monitor trips in real time and do not dispatch help. In an emergency, always contact the emergency services directly.
Safety features depend on your phone, permissions, battery and network, and may not work. Use your own judgement before and during every trip.
19. Content & intellectual property
The Kwiker name and logo, software, design and platform content belong to DashDotSystems SH.P.K. or its licensors and are protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose.
Your user content stays yours. You give us a free, non-exclusive licence to store, display and use it as needed to operate and protect the service, for as long as we keep it under the Privacy Policy. You are responsible for having the right to upload it.
20. Suspension & termination
You may stop using Kwiker at any time and delete your account (see Delete your account).
We may warn, restrict, suspend or permanently remove an account, or refuse a sign-up or verification, where we reasonably believe there has been a breach of these Terms or the Community Guidelines, a risk to the safety of others, fraud, or where the law requires it. Where it is reasonable and safe to do so, we will tell you why. If you think we got it wrong, write to us (§27) and a member of our team will look at the decision again.
21. Disclaimers & limitation of liability
We provide the platform free of charge, “as is” and “as available”. We do not promise that it will work without interruption or errors, that you will find a ride or a passenger, or that information provided by users is accurate.
Because Kwiker is an intermediary and not a carrier (§3), to the maximum extent the law allows Kwiker is not liable for accidents, injury, delays, cancellations, no-shows, damage to vehicles or property, lost items, the condition or legality of any vehicle, the way anyone drives, or the conduct of any user or companion. Responsibility for the journey sits with the driver and the passenger (§4).
To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profit or lost opportunity, and our liability is limited to direct damage that was foreseeable when these Terms were accepted.
Nothing in these Terms excludes or limits our liability for damage caused intentionally or by gross negligence, for death or personal injury caused by our negligence, for fraud, or in any other case where the law does not allow it. Nothing affects the mandatory rights consumer-protection law gives you.
22. Your indemnity
To the extent the law allows, you will compensate us for third-party claims, and the reasonable costs connected with them, that arise from your breach of these Terms or of the law, from your content, or from your driving or conduct during a trip — to the extent you caused them. This does not apply to damage we caused.
23. Force majeure
We are not liable for failure or delay caused by events beyond our reasonable control, such as natural disasters, pandemics, war, civil unrest, decisions of authorities, power or internet outages, or failures of our service providers.
24. Changes
We may update these Terms when the service or the law changes. We will publish the new version here and update the date above. For material changes we will tell you by email or in the app at least 15 days before they take effect, unless a change is required by law or for safety reasons and must apply sooner. If you do not agree, you may stop using Kwiker and delete your account before the change takes effect; if you keep using Kwiker after that, you accept the updated Terms.
25. Governing law & disputes
If you have a complaint, contact us first (§27) — we would like the chance to put it right. We reply in writing.
These Terms are governed by the laws of the Republic of Kosovo. Disputes are decided by the competent courts in Prishtina. This does not remove your mandatory rights as a consumer, including the protection of the law of the country where you live and your right to bring proceedings there, or your right to turn to consumer-protection bodies or out-of-court dispute resolution.
26. General
- Severability. If a provision is invalid or unenforceable, the rest stays in force and that provision applies to the maximum extent the law allows.
- Entire agreement. These Terms, the Privacy Policy and the Community Guidelines are the whole agreement between you and us about Kwiker.
- No waiver. If we do not enforce a right straight away, we have not given it up.
- Transfer. We may transfer these Terms to a successor of our business; your rights as a consumer are not affected. You may not transfer them without our consent.
- Language. These Terms are published in English and Albanian. Both versions have the same meaning.
