1. Acceptance
These Terms & Conditions (“Terms”) form a binding agreement between you and Kwiker (“Kwiker”, “we”). By creating an account or using the Kwiker app or website, you accept these Terms and our Privacy Policy. If you do not accept them, do not use Kwiker.
2. Definitions
- Platform — the Kwiker mobile app and the kwiker.app website.
- Provider (driver) — a verified user who publishes a route and offers empty seats in their own vehicle.
- Passenger — a user who requests and takes a seat on a published trip.
- Trip — a journey published by a provider on the platform.
- Contribution — the cash amount a passenger pays a provider toward the cost of the trip.
3. Kwiker's role — an intermediary, not a carrier
This section is important. Kwiker is a technology platform that connects people travelling the same way. Kwiker is not a taxi company, not a transport operator, not a carrier, and does not provide transport services.
Kwiker does not employ providers. Providers are independent individuals driving their own vehicles on journeys they had already planned. The transport itself is an arrangement between the passenger and the provider; Kwiker is not a party to that arrangement.
Kwiker operates a cost-sharing model: the contribution is intended to help the provider cover the costs of the journey (such as fuel and wear), not to generate profit. Providers must not use the platform to run a commercial transport business.
Kwiker does not hold, transmit, or process the contribution. Payment is made in cash, directly between passenger and provider.
4. Eligibility & age
- You must be at least 16 years old to use Kwiker as a passenger.
- You must be at least 18 years old and hold a valid driving licence to offer rides as a provider. Your age is read from the official identity document you scan, not self-declared. Holding a valid licence is your own declaration and your own responsibility — see §7.
- You must have the legal capacity to enter into these Terms and must not be barred from the platform under §15.
5. Your account
You must provide accurate information, keep it up to date, and keep your credentials confidential. One person, one account. You are responsible for activity under your account.
Impersonating another person, creating an account on someone else's behalf, or using a false identity is a serious breach and will result in removal.
6. Provider verification
Before offering rides, a provider must complete identity verification through our verification partner (see Privacy §5). Verification confirms identity only.
Verification is not an endorsement. It does not certify a provider's driving ability, their vehicle's condition, their insurance cover, or their conduct. Kwiker may re-run, suspend, or revoke verification at any time.
7. Provider obligations
As a provider, you confirm and agree that you:
- hold a valid driving licence and are legally permitted to drive in each country on the route;
- own, or are lawfully entitled to use, the vehicle, and it is roadworthy, registered, and technically compliant;
- hold valid motor insurance covering the vehicle and its occupants for the journey — including carrying passengers under a cost-sharing arrangement. It is your responsibility to confirm this with your insurer.
- publish only journeys you genuinely intend to make, with an honest route, time, and seat count;
- set a contribution that reflects a genuine share of costs and does not seek profit;
- never drive under the influence of alcohol, drugs, or medication that impairs driving;
- comply with all applicable traffic, transport, tax, and border rules;
- do not operate a commercial transport or taxi service through the platform.
8. Passenger obligations
As a passenger, you agree to:
- arrive on time at the agreed pickup point, and communicate promptly if your plans change;
- pay the agreed contribution in cash, in full, for the seat you booked;
- behave respectfully toward the provider and other passengers, and wear a seatbelt;
- never carry an illegal, dangerous, or prohibited item, and never ask a provider to break the law;
- respect the provider's vehicle and any stated preferences (for example, luggage limits).
9. Booking & cash payment
A passenger requests a seat; the provider accepts or declines. A booking exists only once the provider has accepted the request.
The contribution shown in the app is set by the provider and is payable in cash, directly to the provider. Kwiker takes no commission, holds no funds, and is not a payment service.
Neither party may demand more than the agreed amount. Any dispute over payment is between the passenger and the provider. Kwiker may take it into account for moderation purposes, but is not a party to it and cannot refund or recover money.
10. Cancellations & no-shows
Plans change. Both parties should cancel as early as possible, so the seat can be re-offered or the passenger can find another ride.
- A passenger may cancel a request before or after acceptance, through the app.
- A provider may cancel a trip; all affected passengers are notified.
- If a provider materially changes a trip after acceptance (for example, the time or the contribution), the passenger may cancel without penalty.
- Repeated late cancellations or no-shows harm the community and may lead to suspension (§15).
11. Ratings & reviews
After a trip, both parties may rate and review each other. Reviews must be honest, based on a real trip, and free of insult, discrimination, or personal data about third parties.
Kwiker may remove a review that breaches these Terms or the Community Guidelines. Ratings you have left about others may remain visible, in anonymised form, after you delete your account.
12. Prohibited conduct
You must not:
- harass, threaten, discriminate against, or endanger anyone;
- use Kwiker for any unlawful purpose, including smuggling or trafficking of any kind;
- post false trips, write fake reviews, or manipulate ratings;
- scrape, reverse-engineer, overload, or interfere with the platform or its security;
- collect or misuse other users' personal data, or contact them for purposes unrelated to the trip;
- run a commercial transport, delivery, or taxi operation through the platform;
- evade a suspension by creating a new account.
12a. Blocking & reporting
You may block any other user, and you may report any other user. Blocking works both ways: once you block someone, neither of you will see the other's trips, be able to message the other, or be able to request or offer a seat to the other. We do not tell the person that you have blocked them, and you can unblock at any time from Profile → Safety.
Blocking has limits you should know before you rely on it:
- if either of you has already been accepted onto a trip that has not finished, that booking stands and the conversation stays open until the trip ends — we will not strand a passenger, or cut a passenger off from their driver mid-journey;
- it does not hide the other person's name, photo or rating, which every user can see;
- it does not remove ratings or reviews either of you has already left.
Messages sent to you by a person you have blocked are stored but never shown to you. Nothing in these Terms promises that a message you send will be delivered or read.
We review every report within 24 hours and act under the Community Guidelines. We may not be able to tell you what we decided about another person's account, because that is their personal data.
13. Safety features & their limits
Kwiker provides safety tools: identity verification, an SOS button, live trip sharing, location sharing, emergency contacts, ratings, and reporting.
These tools assist you; they do not guarantee your safety, and Kwiker is not an emergency service. The SOS button places a call to the public emergency number (112 in Kosovo). It does not summon Kwiker staff. Kwiker does not monitor trips in real time and does not dispatch help. In an emergency, always contact the emergency services directly.
Safety features depend on your device, permissions, battery, and network, and may be unavailable. Use your own judgement before and during every trip.
14. Content & intellectual property
Kwiker, its name, logo, software, and design are owned by Kwiker and protected by law. We grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose.
You keep ownership of the content you submit (profile photo, trip details, messages, reviews). You grant Kwiker a licence to host, display, and use that content as needed to operate the service. You are responsible for having the right to submit it.
15. Suspension & termination
You may stop using Kwiker at any time and delete your account (see Delete your account).
We may warn, restrict, suspend, or permanently remove an account where we reasonably believe there has been a breach of these Terms or the Community Guidelines, a risk to the safety of others, fraud, or where required by law. Where proportionate, we will tell you why and how to appeal.
16. Disclaimers & liability
Kwiker provides the platform “as is” and does not warrant uninterrupted or error-free operation.
Because Kwiker is an intermediary and not the carrier (§3), Kwiker is not responsible for the conduct of any user, the condition or legality of any vehicle, the quality or safety of the driving, or for delays, accidents, injury, loss, or damage arising from a trip. Responsibility for the journey sits with the provider and the passenger.
Nothing in these Terms excludes or limits liability where it cannot lawfully be excluded — including for death or personal injury caused by our negligence, or for fraud. Subject to that, our liability is limited to the maximum extent permitted by applicable law.
17. Changes
We may update these Terms as the service develops. We will publish the new version here and update the date above. For material changes we will give reasonable notice in the app or by email. If you continue using Kwiker after a change takes effect, you accept the updated Terms.
18. Governing law & disputes
These Terms are governed by the laws of the Republic of Kosovo. Disputes are subject to the jurisdiction of the competent courts of the Republic of Kosovo, without prejudice to any mandatory consumer right to bring proceedings in your country of residence.
Consumers may also have access to out-of-court complaint mechanisms.
